Terms of Service

These terms govern your use of Vocaligence. Please read section 3 (emergencies) and section 5 (recording and consent) carefully — they place real obligations on you.

Effective August 5, 2026. Vocaligence is a service of Nováre Telecom, a d/b/a of Novare Digital Corp, a Tennessee corporation, 1089 Bailey Ave, Suite 200, Chattanooga, TN 37404. Novare Digital Corp is the contracting entity under these terms; "Novare Telecom" and "Vocaligence" are trade names it operates under.

1. What Vocaligence is

Vocaligence is an AI-powered telephone answering and account-servicing product supplied by Novare Digital Corp ("we", "us", "our"). It answers calls to telephone numbers you direct to it, holds spoken conversations with your callers, and — where you have enabled it and the caller has been verified — performs a defined set of changes to your telephone service.

2. It is software, and it will sometimes be wrong

Vocaligence uses automated speech recognition and large language models. It can mishear, it can misunderstand, and it can decline to act. You accept that the service is provided on an "as is" and "as available" basis, without warranty that it will be uninterrupted, error-free, or that it will correctly interpret every caller.

Where the system cannot help, it is designed to transfer the caller to a human or take a message. That behavior is a design goal, not a guarantee of any particular outcome on any particular call.

3. Not for emergencies

Vocaligence must not be used to place, receive, or route emergency calls, and must never be relied upon to reach emergency services. It is an answering and administrative service only. If a caller has an emergency they must dial 911 (or the local emergency number) directly from a phone capable of reaching emergency services. We are not liable for any consequence of a caller attempting to reach emergency help through this service.

Where we provide you with telephone service, emergency calling and registered emergency address obligations are handled under that telephone service and not by Vocaligence. You are responsible for keeping the service address on file for each of your locations accurate and current.

4. Your account, your callers

You are responsible for: the accuracy of the information you give us to configure the service; the telephone numbers you point at it; keeping account PINs confidential; and notifying your own callers that calls to your numbers are answered by an automated system and may be recorded or transcribed (see the Privacy Policy, and section 5 below).

5. Recording, transcription and consent

Calls handled by Vocaligence are transcribed, and may be recorded, in order to operate the service, create records of requests, and improve accuracy. Recording and monitoring laws vary by state and country. You are responsible for providing any notice and obtaining any consent that applies to your callers, including in jurisdictions requiring all-party consent. We provide configurable greeting text so that a notice can be delivered at the start of a call; using it is your decision and your obligation.

6. Changes the system may make

Verified callers may direct a limited catalog of changes to your telephone service — such as call forwarding, extension names, caller ID, voicemail routing, do-not-disturb, ring time, and voicemail PIN reset. Verification requires a PIN entered on the telephone keypad. A PIN spoken aloud is not accepted. Caller ID is never treated as proof of identity.

The system will not spend your money. Anything that creates a cost — adding lines, ordering numbers, porting — is only ever submitted as a request for a human to approve. The system does not accept card numbers by voice and cannot issue credits or refunds.

7. Fees and billing

All amounts are in US dollars and exclusive of taxes, surcharges and regulatory fees. Payment is processed by Stripe; we do not receive or store your card number.

8. Term, cancellation and your telephone numbers

Minimum term. Your minimum service term, if any, and any early termination fee are those set out in the order form or service agreement you sign. Where no term is specified, the subscription runs month to month and you may cancel at any time, effective at the end of the current billing period.

We do not prorate partial months except as stated in the Refund Policy.

Your telephone numbers. Telephone numbers assigned to or ported to your account are yours to take with you. We will not refuse a valid port-out request in order to retain your business. Any outstanding balance, minimum-term commitment or early termination fee remains payable, and is enforced as a debt rather than by withholding your numbers.

9. Acceptable use

You may not use the service to place unsolicited bulk or automated outbound calls, to harass, to impersonate another person or business, for any unlawful purpose, or in any way that would cause us to breach our own carrier obligations. We may suspend the service for conduct in this section.

10. Availability, suspension and termination

We may suspend or terminate service for non-payment, for breach of section 9, or where required by law or by an upstream carrier. We aim to give notice where circumstances allow.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amounts you paid us for the service in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or missed calls.

12. Changes to these terms

We may update these terms. Material changes will be posted with a revised effective date, and where the change materially reduces the service you may cancel without penalty.

13. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to conflict of law rules. Venue lies in the state or federal courts located in Hamilton County, Tennessee.
